What is Alternative Dispute Resolution?

Alternative Dispute Resolution (ADR) is a set of processes used to resolve disputes without going to court. The goal is to help people and organizations resolve conflicts more efficiently, collaboratively, and cost-effectively than traditional litigation.

Instead of a judge deciding the outcome, ADR relies on neutral third parties—such as Mediators or Arbitrators—to help the parties reach a resolution.

There are two core types of ADR: Mediation and Arbitration.

What is Mediation?

Mediation at Haas ADR is a voluntary and confidential process in which a neutral mediator facilitates constructive communication and negotiation between parties. The goal is to help participants identify underlying interests, explore options, and reach mutually acceptable agreements without the adversarial nature of litigation. Haas ADR employs all industry-standard mediation methodologies—including facilitative, evaluative, and transformative Mediation—and adapts the approach to the needs of each case. Mediation services are available in person (in the Bexar County, Texas geography) or online (any geography) and are well suited for disputes where parties seek collaborative solutions, ongoing relationships, or customized outcomes.

What is Arbitration?

Arbitration is a private adjudicative process in which a neutral arbitrator or panel reviews evidence and issues a decision. Haas ADR offers both binding and non-binding arbitration, as well as institutional and ad hoc formats under widely recognized arbitration rules or customized procedures. Arbitration provides parties with a faster, more cost-effective alternative to court litigation while maintaining confidentiality and allowing decision-makers with industry-specific expertise. Procedures may be streamlined or accelerated when disputes require prompt resolution, and parties retain flexibility in shaping the process.
